These Terms of Service (“Terms”) govern your access to and use of the Charmzone website (the “Site”) and any purchase of products or services from us (collectively, the “Services”). By accessing the Site or using any part of the Services, you agree to be bound by these Terms and our policies referenced herein (including our Privacy Policy and Return & Refund Policy). If you do not agree, do not use the Site.

For purposes of these Terms, “Charmzone,” “we,” “us,” and “our” refer to Charmzone Global.

1) Eligibility & Account Responsibility

You must be at least the age of majority in your jurisdiction to use the Services. If you create an account, you agree to provide accurate information and to keep your account credentials secure. You are responsible for all activity under your account.

2) Changes to These Terms

We may update these Terms from time to time by posting a revised version on the Site. The “Last updated” date above indicates when these Terms were last changed. Your continued use of the Services after changes become effective constitutes your acceptance of the updated Terms.

3) Online Store & Platform Providers

The Site and checkout experience may be hosted or supported by third-party service providers (including e-commerce, payment processing, fraud prevention, analytics, shipping, and customer support vendors). Your use of the Services may also be subject to such providers’ terms and policies where applicable.

4) Product Information & Availability

We strive to display product descriptions, images, ingredients, and other information as accurately as possible. However, we do not guarantee that all product details are error-free, complete, or current. Colors and appearance may vary by device.

Products may be available in limited quantities and may be discontinued at any time.

5) Pricing, Promotions, and Errors

Prices, promotions, and availability are subject to change without notice. We reserve the right to correct pricing errors, typographical errors, or inaccurate information at any time (including after an order is submitted). If a product is listed at an incorrect price, we may cancel or refuse any order placed for that product.

6) Order Acceptance, Cancellation, and Limits

Your order is an offer to purchase. We reserve the right to accept, refuse, cancel, or limit orders for any reason, including suspected fraud, unauthorized or illegal activity, or orders that appear to be placed by dealers, resellers, or distributors.

If we cancel or change an order, we may attempt to notify you using the contact information provided at checkout.

7) Payment

By submitting payment information, you represent that you are authorized to use the payment method. We may use third-party payment processors. You agree to pay all charges incurred by you or on your behalf through the Services, including applicable taxes and shipping/handling (if any).

8) Shipping & Delivery

Shipping timelines are estimates and not guaranteed. Risk of loss and title to products pass to you upon delivery to the carrier to the extent permitted by law, or as otherwise required by applicable law. We are not responsible for delays caused by carriers, customs, weather, or events beyond our reasonable control.

9) Returns, Refunds, and Replacements

Returns and refunds are governed by our Return & Refund Policy, which is incorporated into these Terms by reference.

If your order arrives damaged or has a shipping-related issue, contact us within the timeframe stated in our Return & Refund Policy and provide clear photo evidence (including the outer shipping box and shipping label). If verified, we will send a replacement item at no additional cost, subject to stock availability. If a replacement is not available, we may offer an alternative resolution.

10) Intellectual Property

All content on the Site—including text, graphics, logos, images, videos, product names, designs, and software—is owned by or licensed to Charmzone and is protected by intellectual property laws. You may not copy, reproduce, distribute, modify, create derivative works from, publicly display, or exploit any content without our prior written permission.

11) User Submissions (Reviews, Comments, Messages)

If you submit reviews, comments, suggestions, photos, videos, or other materials (“User Content”), you represent that you have the rights to submit it. You grant Charmzone a worldwide, non-exclusive, royalty-free, perpetual, irrevocable license to use, reproduce, modify, publish, translate, distribute, and display such User Content in any media for lawful business purposes (including marketing and product improvement), subject to applicable law.

We may remove User Content at any time if we believe it violates these Terms or applicable law.

12) Prohibited Uses

You agree not to use the Site or Services to:

Violate any law or regulation
Infringe intellectual property or privacy rights
Harass, threaten, defame, or discriminate
Upload or transmit malware, viruses, or harmful code
Attempt to gain unauthorized access to systems or accounts
Scrape, crawl, or use automated methods to access the Site without permission
Engage in fraudulent transactions or abuse promotions
Resell products in violation of our policies or applicable laws

We may suspend or terminate access to the Services for any violation.

13) Third-Party Links & Tools

TO THE FULLEST EXTENT PERMITTED BY LAW, CHARMZONE DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Site will be uninterrupted, secure, error-free, or free of harmful components.

15) Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, CHARMZONE AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUE, ARISING FROM OR RELATED TO YOUR USE OF THE SITE OR SERVICES.

IN NO EVENT WILL CHARMZONE’S TOTAL LIABILITY EXCEED THE GREATER OF (A) USD $100 OR (B) THE AMOUNT YOU PAID TO CHARMZONE FOR THE PRODUCT(S) OR SERVICES GIVING RISE TO THE CLAIM.

Some jurisdictions do not allow certain limitations, so portions of this section may not apply to you.

16) Indemnification

You agree to defend, indemnify, and hold harmless Charmzone and its affiliates from any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to your violation of these Terms, your misuse of the Services, or your infringement of any rights of another.

17) Electronic Communications

You consent to receive communications from us electronically (e.g., by email, account notifications, or posting notices on the Site). You agree that such communications satisfy any legal requirements that communications be in writing.

18) Copyright & DMCA Notice (United States)

If you believe content on the Site infringes your copyright, please email us at info@charmzoneglobal.com with:

Identification of the copyrighted work claimed to be infringed
Identification of the material you believe is infringing and where it is located on the Site
Your contact information (name, address, phone, email)
A statement that you have a good faith belief the use is not authorized
A statement, under penalty of perjury, that the information is accurate and you are the copyright owner or authorized to act on the owner’s behalf
Your physical or electronic signature

19) Dispute Resolution; Arbitration; Class Action Waiver (Optional but Recommended)

PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS.

Except where prohibited by law, you and Charmzone agree that any dispute arising out of or relating to these Terms or the Services will be resolved by binding arbitration, and not in court, and that you waive the right to a jury trial.

Class Action Waiver: You and Charmzone agree that disputes will be brought only in an individual capacity and not as a plaintiff or class member in any purported class, collective, or representative proceeding.

Opt-Out: You may opt out of arbitration by emailing us at info@charmzoneglobal.com within 30 days of the date you first accept these Terms, with your name, order number (if any), and a clear statement that you wish to opt out of arbitration.

If arbitration is not enforceable for a particular claim, that claim will be resolved in the courts as set forth in the Governing Law section below.

20) Governing Law & Venue

These Terms and any dispute arising out of or related to them are governed by the laws of the State of California, without regard to conflict of laws principles. If a dispute may be brought in court (as permitted under these Terms), you agree to submit to the exclusive jurisdiction of the state and federal courts located in Los Angeles County, California, unless otherwise required by applicable law.

21) Severability, Waiver, and Entire Agreement

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will remain in full force and effect. Our failure to enforce any provision is not a waiver of our right to do so later.

These Terms, together with any policies referenced herein, constitute the entire agreement between you and Charmzone regarding the Services.
